Once you have completed your online registration procedure, your membership has been activated and you have entered into a legally binding contract for the provision of Lovebrighton.com dating service.

People who register for the Lovebrighton.com Dating Service become "Members". The Membership divides between those who decide to pay our fee for membership which we call "Full Members", and those who do not "Standard Members".

As part of the member registration process, you will be asked to select a username ("Member ID") and password. We may refuse to accept any Member ID for any reason, including that the proposed member ID impersonates someone else, is or maybe illegal, is or maybe protected by trademark or otherwise infringes on other proprietary rights, is vulgar or otherwise offensive, or may cause confusion, as we determine in our sole discretion. You may only have only one Member ID. You agree not to resell or transfer your use of or access to the Site to any third party.

If you have reason to believe that your account is no longer secure, you must change your password by updating your account information in The "My Lovebrighton" page.

As part of the member registration process you will be asked to upload a primary photograph (which we may need to crop or adapt appropriately).Photographs may not be offensive, pornographic or detrimental to the reputation of Lovebrighton.com in any way and we reserve the right to remove any photographs that we consider inappropriate. If you do not upload a photograph, your profile will not appear on the Lovebrighton website.

You undertake to register for the Lovebrighton.com Dating Service using accurate and current information about yourself-including your correct name, address and any other requested details.

As part of the registration process for the Lovebrighton.com Dating Service, you will receive a verification email, the purpose of this is to take reasonable steps to ensure that the email address you have nominated during registration is controlled by you. This email contains simple instructions which you must follow.

If you decide to become a full Member and therefore pay our full membership fee. you are agreeing to take the Full Membership we make available to you promptly upon receipt of that fee. As a result you will not have the right to cancel this Agreement, or to any refund of that fee, during any cooling-off period under the United Kingdom`s Consumer Protection (Distance Selling) Regulations 2000.  Refunds are only given in exceptional circumstances at the discretion of Lovebrighton.

The Full Membership fee will be communicated to you when you sign up for Full Membership. Full Membership is available monthly, three-monthly or six-monthly as selected by you; it will need to be renewed if you wish to continue benefiting from Full Membership.

Lovebrighton.com Dating`s privacy policy forms part of this Agreement, and by agreeing to this Agreement, you also give your consent to the way we may handle your personal date as detailed in that policy. Given the global nature of the World Wide Web, any postings on the Lovebrighton.com Dating Service (including any which contains personal information) is, of course, accessible to internet users around the world.

We reserve the right (a) to suspend or terminate any Member's access to the Lovebrighton.com Dating Service, or parts of it,and/or (b) to remove or require the Member to remove, material posted on the Lovebrighton.com Dating Service, if the relevant Member or material appears to us, or to a complainant, to be in breach of any provision of this Agreement. Any person whose access has been suspendedor terminated must not re-register for, or re-access, the Lovebrighton.com Dating Service without our prior consent. You are responsible for everything which is done on or through the Lovebrighton.com Dating Service while your Membership account is logged on to the Lovebrighton.com Dating Service, or through your email address. In addition, we reserve the right to suspend or terminate any Member's access to the Lovebrighton.com Dating Service, or parts of it,if the relevant Member is abusive, discriminatory or threatening to, harasses or communicates offensive messages or images to another Member, whether or not through the Lovebrighton.com Dating Service. For completeness, where we reserve a right in this Agreement, it does not mean we will be obliged to exercise it. Also, given the nature of the Lovebrighton.com Dating Service, we cannot prevent determined people whose Membership has been suspended or terminated from re-accessing or re-registering as Members, in breach of their obligations under this Agreement.

Members must not: - include an email address,postal address, phone number, the address of any website, or any other information which is intended to facilitate direct communication, in material which is posted on the Lovebrighton.com Dating Service - Full Members, and the recipients of their emails, can share this information, should they wish, once direct contact has been made; -place material on, or otherwise use, the Lovebrighton.com Dating Service for any business, advertising or commercial purpose (including,for example, the offering of escort or similar agency services); or -use their access to the Lovebrighton.com Dating Service, or information gathered from it, for the sending of unsolicited bulk email (sometimes known as spam).

You acknowledge that all copyright, trade marks, and other intellectual property rights in and relating to the Lovebrighton.com Dating Service, other than material which is contributed by Members, are owned by Lovebrighton.com Dating. It is easy to copy material which appears on web-sites, but this does not mean it is legal. Therefore, no-one may copy, distribute, show inpublic or create any derivative work from the Lovebrighton.com Dating Service, or any of the material which is found on the Lovebrighton.com Dating Service, unless properly licensed to do so by (a) us, and (b)where material contributed by one or more Members is concerned, by the Member(s) in question.

By submitting any material to the Lovebrighton.com Dating Service, you; - are representing that you are fully entitled to do so; - grant us a non-exclusive, royalty-free,non-terminable licence to copy, modify, distribute, show in public and create derivative works from that material solely in the course of its processing and display on and through the Lovebrighton.com Dating Service in accordance with this Agreement; and - authorise us to adapt the relevant material in the course of doing so, and so waive your moral rights to object to any derogatory treatment, or to be identified as the author, of the material in question.

We will not beliable to you or any third party for any loss not reasonably foreseeable by us when this Agreement commences, for any in direct or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise). Lovebrighton.com Dating will also not be liable for any failure to perform its obligations under this Agreement caused by matters beyond its reasonable control.

Without limiting the preceding Clause, the aggregate liability of Lovebrighton.com Dating under this Agreement (whether arising in negligence or otherwise) will not under any circumstances exceed the greater of (a) the six-monthly Full Membership fee payable at the time liability arises, or (if greater) (b) the sums paid by you to us under this Agreement during the six month period prior to the date when liability arises, regardless of the cause or form of action.

Nothing in this Agreement limits Lovebrighton Dating's liability for death or personal injury resulting from our negligence, or any other liability which may not by law be excluded. Any statutory rights you may have as a consumer remain unaffected.

We reserve the right to assign this Agreement, and to assign or subcontract any or all of our rights and obligations under this Agreement. You may not without the written consent of Lovebrighton.com Dating assign or dispose of this Agreement.

This Agreement includes our Lovebrighton.com Dating Privacy Policy. Together they contain the whole of the agreement between us and you concerning the Lovebrighton.com Dating Service and they replace all earlier agreements and understandings with you, except for any fraud or fraudulent representation by either of us. A person who is not a party to this Agreement has no right under the Contracts (Rights of Third Parties)Act 1999 to rely upon or enforce any term of this Agreement.

Lovebrighton.com Dating reserves the right to change the Agreement with its Members from time to time, and post the new version on the Lovebrighton.com Dating Service. When we do so, we notify Members of the fact that there are changed terms on the main screen(www.Lovebrighton.com). This Agreement, and any new version of it in the future, takes effect immediately. However, if you do not wish to bebound by the changes we make in this Agreement (or any new version of it), then you can choose instead to remain bound by the previous Terms and Conditions until:
- your next Full Membership renewal, if you are a Full Member; or
- one month after the date when we post the new version, if you are a Standard Member.

In the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.

This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

We don't separately file the individual Agreements entered into by Members when they register for the Lovebrighton.com Dating Service. Please make a durable copy of this Agreement by printing and/or saving a downloaded copy on your own computer.
